Code Switching Essay

Abstract: Though codeswitching research may vary from context to context and situation to situation, the common factors for code switching will be threefold. That is, code switching deals with languages in contact. In interactive social situations code switching will be the use of more than one language For example the interaction during various social events involving interlocutors who know more than one language. With these common factors of code switching this paper looks into the Malaysian context with special thrust to the various reasons involved for code switching during the social interactions. Data for the present paper were collected from the Tamil speaking undergraduate students of the University Putra Malaysia, Malaysia. Their interaction in different identified domains involving three languages viz. Tamil, Malay and English were looked into. Gumperz (1982) while discussing the communicative function of code switching, claims that the speaker plays upon the connection of the we-code to create conversational effect. Thus code switching is seen as fulfilling the relational and referential functions of language that amounts to effective communication and interlingual unity. Apart from this function of code switching ,this paper could identifies several other reasons for code switching in the situations under study. Communicative functions and Reasons for Codeswitching : Malaysian Perspective . Code switching is an everyday reality in every place where more than one language is spoken in everyday communications. Many scholars have studied  extensively about the patterns of code switching and the reasons for code switching. The present paper discusses the communicative functions of code switching and also the sociolinguistic, cultural and pedagogic reasons for code switching in the Malaysian context. Data for the present study were collected from Tamil speaking University students who have enrolled as undergraduate students in the University Putra Malaysia, Malaysia. The data were collected from these students while they were interacting in different domains viz. classroom, university campus, family, market, neighborhood etc. In all these domains they have to interact with Malay and Chinese speakers apart from as well as with other Tamil speakers. It is observed that all the students from whom the data were collected are competent to a certain extent in Tamil, Malay and English. Communicative Functions of Codeswitching Gumperz (1982) when discussing communicative functions, mentions the discourse function of codeswitching, also called the personalization function of language. A speaker plays upon the connotation of the we-code to create a conversational effect. Thus, code switching is seen as fulfilling the relational and referential function of language that amounts to effective communication and interlingual unity. Halliday (1975) on the other hand, views code switching as fulfilling the interpersonal function of communication. Here the mixed language spoken plays the role of a mediator. In other words, it is the use of language to act as a mediator between self and participants in the communicative event. In fulfilling the relational and referential functions, code switching is seen as the medium to convey both social and linguistic meanings. Gumperz (pg. 144, 1982) lists examples of situations created to convey meaning as given below: to appeal to the literate to appeal to the illiterate to convey precise meaning to ease communication, i.e., utilizing the shortest and the easiest route to negotiate with greater authority to capture attention, i.e. stylistic, emphatic, emotional to emphasize a point to communicate more effectively to identify with a particular group to close the status gap to establish goodwill and support Karen Kow (2003) listed in her article a few possible conditions for code switching. Some of the conditions given are, lack of one word in either language Some activities have only been experienced in one of the languages Some concepts are easier to express in one of the languages A misunderstanding has to be clarified One wishes to create a certain communication effect One continues to speak the language latest used because of the trigger effect One wants to make a point One wishes to express group solidarity One wishes to exclude another person from the dialogue. Kow suggests that from the list above, it may be possible to predict which conditions act on a particular sociolinguistic context for codeswitching, for example, when a person who lacks a word in English due to limited vocabulary code switches by using the lexical component from his/her first language instead of English. Therefore, the function here is to overcome the language barrier to meaning-making. Another example is a condition where the speaker, intending to express group solidarity, employs code switching. The function for the switch in this case is to establish goodwill and rapport. Similarly series of conditions can be established for the phenomenon of code switching depending on the social context. Such communicative functions of codeswitching can also be listed according to the functions that they try to accomplish. Among these, the following ten functions have been described in the professional literature (Malik, 1994): Lack of Facility Lack of Register Mood of the Speaker To emphasize a point Habitual Experience Semantic significance To show identity with a group To address a different audience Pragmatic reasons To attract attention. 1. Lack of facility : According to Malik (1994), bilinguals or multilinguals often explain that they code switch when they cannot find an appropriate expression or vocabulary item or when the language of conversation does not have the particular word needed to carry on the conversation smoothly. He offers the example of â€Å"Charan Sparsh† (touching feet) that does not convey the same meaning in the speaker’s code as it does in Hindi. The reason for switching may however be culturally conditioned and David (2003) notes that an alien concept often has a speaker switch to the language from which the concept is borrowed. For example, like the lexical item social drinker in English that is unacceptable in a Malay situation because of the simple fact that drinking alcohol is prohibited in Islam and the Malay-Muslim world does not have a word for it that is equivalent to its meaning in English. Hence, the phrase social drinker is directly borrowed and used as an instance of phrase level mixing as in the following example: Saya difahamkan bahawa OKS jarang minum, hanya seorang social drinker [I understand that OKS seldom drinks, he is only a social drinker] 2. Lack of register: When speakers are not equally competent in two languages and when the speakers do not know the terms in two languages, then codeswitching occurs. For example, college students often code switch by moving from Hindi to English. In certain occupations code switching takes place in the speech of doctors, lawyers, engineers while they interact among  themselves owing to the fact that proper terms in Hindi or in any other language other than English may not be available to them. As a result, they utilize the English terminology that they are familiar with. Thus, one can identify a great deal of lexical code mixing. As David (2003) notes, it is vital for a courtroom setting in Malaysia that a specific terminology be used to refer correctly to an object or a character. The use of the exact terminology or vocabulary is important in this setting when the terminology plays an important role and has the potentiality to make a major impact on life and death, freedom or imprisonment. Therefore, whichever the code is that enables the speaker to get his/her exact meaning across will be the one that is acceptable to the interactants including one where language mixing occurs. The following example cited by David is to the point: Ujian alcohol telah dijalankan iaitu breath analyzer test. [The alcohol test was conducted, i.e., a breath analyzer test] The term breath analyzer is in English rather than in the matrix language, Bahasa Malaysia, simply because of its context-bound significance. 3. Mood of the speaker: Malik (1994) claims that usually when bilinguals are tired or angry, code switching takes place with a new dimension. This means, when the speaker is in the right state of mind, he/she can find the appropriate word or expression in the base language. Very often he/she knows exactly the word in both the languages (X and Y) but the language Y may be more available at the point of time when the speaker has a disturbed mind. Such circumstances may create a hurdle in getting the appropriate word or phrase in the language in which the speaker may be more proficient if he is not mentally agitated. 4. To emphasize a point: Switching is also used to emphasize a point. Gal (1979) reports several instances in which a switch at the end of an argument not only helps to end the interaction but may serve to emphasize a point.  She has taken an example from English/German code switching and stressed that switching from English to German is a means of adding more force to the statement. Meanwhile, David (2003) uses the courtroom environment to show how a defending lawyer uses dominant Bahasa Malaysia to start with and shifts to English to emphasize an important point to the judge that the accused had not committed any crime for 10 years. Habitual experience: Malik.(1994) stresses the fact that code switching often occurs in fixed phrases of greeting and parting, commands and request, invitation, expressions of gratitude and discourse markers such as Oyes (listen), you know or pero (but), whereas Hoffman (1971) reports that in Puerto Rican homes, the mother gives short commands to their children in English, such as Don’t do that†¦. and the rest of the mother’s warning will be in Spanish. David (2003), in turn, cites an example of habitual mixed discourse in a Malaysian courtroom where the dominant or matrix language is Bahasa Malaysia: Kes merupakan arrest case atau kes saman? [Is this an arrest case or a summons case?] 6. Semantic significance: Malik (1994), Gumperz (1970, 1976, 1982), and Gumperz and Hernandez (1972) all stresses that switching at a particular moment conveys semantically significant information. It is a communicative resource that builds on participant’s perception of two languages. Lexical choice conveys meaning during codeswitching. Gal (1979) reinforced this view by stating that listeners interpret codeswitching as an indicator of the speaker’s attitude, or communicative intents and emotions as code switching is a tool for conveying appropriate linguistic and social information. By the same token, David (2003) describes a range of speech acts like reprimands, directives, requests, and warnings that are conveyed by using different intricate strategies to show the semantic significance in certain specific situations. It is not only the lawyer who code switches, but also the judge. The example below shows how a judge shifts from Bahasa Malaysia, the national language and the official language at Malaysian courts, to English as a face saving gesture: Kenapa kamu tak setuju, panggilan pertama telah dijawab oleh BG Boy dan dah tentu Das mesti menanya di manakah BG Boy berada? Kamu tak faham soalan, saya maksudkan†¦Ã¢â‚¬ ¦ [Why don’t you agree – Bg Boy responded to the first call and surely Dos asked where he was ? You do not understand the question, I mean†¦.] 7. To show identity with a group: Di Pietro (1977) reports that Italian immigrants would tell a joke in English and give the punch line in Italian, not only because it was better said in Italian but also to stress the fact that they all belong to the same minority group, with shared values and experiences (cited in Malik, 1994). 8. To address a different audience: Malik (1994) states that code switching is also used when the speaker intends to address people coming from various linguistic backgrounds. For example, in India the television announcer often uses Hindi as it is the national language but also switches to English. Also, he often repeats the same in English for South Indians or Indian people who do not know Hindi. Similar types of situations have also been reported in some other settings. Linguistic reinforcement often takes place even in courts, according to David (2003) where counsels tend to speak to a number of different interlocutors at the same time. During such occasions obviously they mix codes or switch codes accordint to the ethnicity of the addressee. One reason for such use of mixed languages is to address simultaneously persons from different linguistic backgrounds. Also, the speaker clearly distinguishes whom he/she addresses and what should be communicated. Hence,  the speaker uses part of the sentence in one language and the other part in another language. In the example below the lawyer used a mixed discourse of English/Malay, and the part of his utterance in English is directed to the judge and the other in Malay is meant for the witness. Business Ownership Essay

There are three different forms of business ownership, the Sole Proprietorship, the Partnership, and the Corporation. Each of these businesses have major advantages and disadvantages. The sole proprietorship is a business which is owned and managed by one individual. Some of its advantages are, the ease of formation, its management control, and its distribution of profits. Some of the disadvantages are, its unlimited liability, the lack of continuity, the capital requirements. Let’s begin with the advantages. A sole proprietorship is very easy to create. Anyone who wants their own business simply needs to get the necessary licenses from, for example, the state, the county, and/or their local government. After he or she obtain these licenses, he/she can begin operating their business. In a sole proprietorship, the sole proprietor has full control over his/her operations. Because he/she has this control, they can respond quickly to the changes that may occur in the market. This is a great motivator for a sole proprietor because he/she can keep up with the trends. The sole proprietor also owns all the profits that his/her business takes in. They themselves own the business and therefore do not have to distribute the profits with anyone else. The only thing that he/she needs to do with the profits is pay the company expenses and the rest is theirs to do with as they please. This tends to be a great incentive for a sole proprietor. Next, we have the disadvantages. The sole proprietorship has unlimited personal liability. The sole proprietor is personally liable for all of the businesses debts. He/she is the sole owner, which means there is no one else responsible to contributing to the payment of debts. This is one of the biggest disadvantages of a sole proprietorship. There is also a lack of continuity in a proprietorship. If for some reason the sole proprietor dies, retires, or becomes incapacitated, the business could end. When this happens, if a member of the family, or an employee, does not take over the business, the business could be in big trouble. A proprietorship is usually a small business, and to find good employees that are dedicated to staying with the business could be hard. The reason for this is that most people look for security, and advancement in their employment, this usually does not exist in businesses which are small. If no one takes over the business, and the business had debts, creditors can go to the courts for a petition to sell off the assets so that they can pay back these debts, therefore the business has discontinued. It is also very hard in a sole proprietorship to obtain capital. Most banks and other lending institutions have certain formulas/requirements for determining how eligible a borrower may be. Many proprietorships do not meet these formulas/requirements and are therefore limited to whatever capital the owner has to contribute, and whatever money he/she can borrow. This can be a major set back in a proprietorship depending on the amount of capital the owner has to invest. The next form of business ownership is the partnership. A partnership is an association of two or more people who co own a business for the purpose of making a profit. Some of its advantages are its ease of formation, its distribution of profits, its capital requirements, and its taxation. Some of its disadvantages are, its unlimited liability, its lack of continuity, and it management control. Once again, let’s start with the advantages. The partnership, like the sole proprietorship, is also easy to establish. All the owners have to do is obtain the necessary business licenses, and submit a few required forms. If the business is run under a trade name, the partners will have to file for a certificate to conduct their business. When the accomplish all of the above, they can start operating their business. In a partnership, an agreement is usually made up outlining the share of profits each partner should receive. It is necessary for the partners to abide by this agreement when it comes to distributing the profits to ensure that each partner receives the right amount. Besides for this technique, there are no restrictions as to how the partners distribute the company’s profits, they just need to stay consistent with the agreement. A partnership also has a broader pool of capital than the sole proprietorship. In comparison to the sole proprietorship, the partnership has several owners instead of one. This means that each partner’s personal assets will support a larger borrowing capacity from lending institutions. When you are a part of a partnership, the business is not subject to federal taxation. A partnerships net income/losses are passed along to the partners as personal income, in which the partners have to pay income tax on. This way, the partnership avoids â€Å"double taxation†. Next, we have the disadvantages of the partnership. One of its main disadvantages is its unlimited liability. One partner is given the title of the general partner. This means that if there are any problems (for example with debts), that partner assumes full responsibility. This is also why the general partner is usually the partner with the least personal resources. A partnership, once again like the Sole Proprietorship, has a lack of continuity. Complications begin to arise if one of the partners die. A partnerships interest inheritance is often non-transferrable because the remaining partner may not agree on working with the person which inherited that portion of the partnership. This would cause great implications in the partnership because one person is no longer there, which means the work that person was responsible for now has to be distributed among the rest. There is a way of avoiding this problem though, the partners can agree on who will obtain the partnership interest in the event of them dying. Lastly, there is great potential for conflicts in a partnership. There is no longer one owner which means control is distributed among several people.  With several people in control, there is no way to completely avoid conflicts. However, the partners will have to learn to work through their problems by communicating with each other. If they do not do this, their conflicts will remain unresolved which could end up being the cause of their partnership, and business, failing. Communication is essential in a partnership, as it is in any form of business. Finally, there is the corporation. A corporation is a separate legal entity apart from its owners, in which receives the right to exist from the state in which it is incorporated. It is the most complex of the three major forms of business ownership. Some of the advantages are, its limited liability, its capital requirements, and its continuity. Its disadvantages are, the cost and time in the incorporation process, the double taxation, and the loss of management control. A corporation lets its investors limit their liability to the corporation by letting them decide the total amount of investment in the business. This is allowed because it is a separate legal entity, whereas a Sole Proprietorship and a Partnership are not. This also gives the corporation stockholders legal protection towards their personal assets outside the business. A corporation has great ability when it comes to attracting capital. The only limitation they have, is the number of shares authorized in its charter, this too can be changed. The corporation can raise money by simply selling shares of some of its stock to investors. This way they gain money to begin business and expand. A corporations future does not lie in the hands of one individual person. It has shares worldwide, and will continue to live as long as people invest in it. The only way a corporation can discontinue, is if it fails to pay its taxes or is limited to a specific length of life by the charter. Next, there are the disadvantages. To start a corporation it can be costly  and time consuming. The actual creating of the corporation can cost between $500 and $2,500. There are also fees involved in establishing a corporation which does not exist with a sole proprietorship, or a partnership. In some states you need the assistance of an attorney to establish the corporation, whereas in others you can do it all on your own. A corporation also has the disadvantage of double taxation. This means that it must pay taxes on its net income at the federal level, in most states, and to some local governments as well. The corporation pays taxes on dividends at the corporate tax rate, then stockholders must pay taxes on the dividends they receive from the same profits at the individual tax rate. As you can see it is being taxed twice. There’s also a potential loss of control by the founder(s) of the corporation. When shares are sold in the company, you are really selling shares of ownership, which gives some control to the person who bought the share. The more shares the founder sells to gain capital, the more control he/she is losing. This could be a big problem and amount to a great loss of control for the founder if he/she needs a large capital infusion. Lastly, the profits of the corporation are widely distributed. People all over the world can obtain shares on the corporation, and therefore receive dividends from the corporation. Therefore the profits are widely distributed among all the shareholders. As you can see from the information I have given, there are three major types of business ownership. All of these types have their advantages and disadvantages, so it depends on what you decide is better for you in starting a business.

Reverse Sexual Harassment

Reverse Sexual HarassmentFebruary 28, 2012AbstractIn what is perceived to still be a male-dominated society, one of the most ambiguous topics to broach is that of reverse sexual harassment. Reverse sexual harassment refers to the sexual harassment of a male by a female. While it is not perceived as the norm, there are several instances of this occurring annually. It is generally supposed the actual number is greatly underreported due to the nature of the offence. Both sexual and reverse sexual harassment are forms of discrimination. These acts of discrimination are against federal and state law. An individual who is the subject of reverse sexual harassment in the workplace can register a complaint with the Equal Employment Opportunity Commission (EEOC). They can file the complaint under the sexual harassment section of the Title VII of the Civil Rights Act of 1964. In 2004, 15% of all sexual harassment charges received by the EEOC were filed by men (Anderson and Trimings 2006:2). The rubric of reverse sexual harassment may be regarded as a facetious incident between a female superior or female co-worker against her male counter-part; however; this is still an act of discrimination which warrants reporting of this incident to management. Before filing a complaint or contacting a lawyer, make sure there is documented evidence compiled on the inappropriate actions of the individual. In the event that the sexual harassment complaint advances to the judicial process, this will support the chances of prevailing in court and with the EEOC.Introduction EmploymentLaw is the legal specialty that regulates the operation of the labor market, in general, and the employment relationship between employers and employees in particular. Examples include the hiring process, suspension from work, maternity rights, layoff, wages and overtime pay, defamation, breach of employment contract, retaliation, freedom of speech in the workplace, military re-hires, unemployment compensatio n, and discrimination. Employment law is governed by numerous laws, regulations and ordinances at he Federal, State and sometimes, the local ordinance level. In a Nut Shell, there are numerous Federal Laws which are generally tailored to protect societal interests such as the Anti-Discrimination provisions embodied in Title VII. Generally speaking, Title VII protects employees from discrimination based on sex, gender, race, ethnic background, religion and retaliation. In the realm of Employment Law, sexual discrimination is one of the most prevalent topics in today’s society. There are various types of sexual discrimination. When the lay person is asked which type of sexual discrimination is documented the most in the business world, to coin a phrase from the game show Family Feud â€Å"Survey says†¦Ã¢â‚¬ , that discrimination towards women in business is the number one answer. To further divvy down to a specific discrimination, would be that of male-on-female sexual harassment in the workplace. This specific discrimination is one of the most widely known and reported cases in a place of business. Albeit, this type of discrimination continues to be a difficult case to prove within what many would consider still a male-dominated business world. However, this exposition of sex discrimination in the workplace will prove that the most challenging discrimination case to prove is that of woman-on-male sexual harassment. Methodology A qualitative evaluation shall be utilized for this research paper leveraging subjective methods such as actual case studies and various scholarly observations to collect substantive and relevant data. The review consists of actual cases filed with the EEOC involving female-on-male sexual harassment cases and multiple interpretations of male sexual harassment cases from legal professionals, business professionals, and academic scholars. Such a qualitative approach is valuable here due to the uncommonness of this type of sex discrimination within contemporary professional situations. Upon collecting the qualitative data derived from said case studies and various scholarly observations, careful analysis shall be done to prepare a valid insight into reverse sexual discrimination rulings and the reporting of these cases at the workplace. Recent research on current workplace cultural and the rise of women in hierarchy positions within companies has yielded validity in the argument of female-on-male sexual harassment in the office. Yet, there are seldom, if any, cases reported to the EEOC by men for sexual harassment. The argument of a cultural base depicting the male role as that of a dominant one; which, leads many to believe that any approach by a woman towards her male co-worker or male subordinate, may be warranted by her male counter-part. Conversely, the governing act of Title VII enforces the rights of men, the same as women, in reporting any wrong-doing within the office. The methodology of this paper will help to substantiate the legitimacy of male sexual harassment in the workplace by a female superior or female co-worker and how employers should implement preventive strategies to minimize risks of sexual harassment in the workplace as well as avoiding costly and timely litigation. There are several different kinds of sexual harassment which will also be conversed within this paper. The methodology is derived from intellectual journals, book excerpts, articles, and on-line resources. Review of the Literature When an offer for employment is made by an employer to an employee, the law governing the relationship between an employee and an employer begins. In terms of employee complaints against other employees and/or management, the employer should implement a form of risk management. This risk management process will adhere to rules and policies set in place by the employer to manage complaints such as sexual harassment. However, the reality for most companies is how much respect is given to reports of woman-on-male sexual harassment by a co-worker or superior. Eve Tahmincioglu (2007) expresses the reality of how male sexual harassment in the workplace may be overlooked in the article, â€Å"Male Sexual Harassment is not a joke. † The author indicates, â€Å"But for quite a few men, sexual harassment is indeed becoming a serious issue, and some men are deciding not to just brush aside the unwelcome advances from women. (2007). Tahmincioglu interviewed a human resources expert, Roberta Chinsky Matuson, who disclosed insight from the human resources’ perspective, â€Å"Many people mistakenly believe that harassment is limited to females,† Roberta Chinsky Matuson added, â€Å"The truth is that this type of experience is just as damaging to men† (Tahmincioglu, 2007). David Grinberg, a spokesman for the EEOC, states â€Å"sexual harassment filings by men have consistently inc reased, doubling over 15 years† (Tahmincioglu, 2007). The vast majority of the EEOC’s sexual harassment suits are filed by women; however, male filings are becoming â€Å"a bigger piece of the pie, with nearly 2000 filing charges last year (2006),† as reported by Tahmincioglu (2007). Unfortunately, the cases which reach the EEOC do not represent the actual number of male sexual harassment filings which may go unreported due to fear of being â€Å"mocked† by coworkers (2007). In some cases, men working in a majority female office may be subject to unprovoked jokes pertaining to men or the male sexual anatomy around the break room, water cooler, or via forwarded emails. This is considered male sexual harassment. Fear of retaliation and mocking may prompt men to not file a complaint. An argument of retaliation is discussed by Tahmincioglu (2007) as the first ever court case involving sexual harassment of a man in the workplace was in 1995. The EEOC sued Domino Pizza after a female supervisor of a male store manager sexually harassed him and then fired him. â€Å"She would caress his shoulders and neck, and pinched his buttocks,† the EEOC said in a statement. The case went to trial in Tampa and the male manager was awarded $237,000 in damages (2007). In this groundbreaking case, the male employee was retaliated against by his superior; however, he pursued his case and eventually won in the court ruling against Domino Pizza and the store manager. In comparison, the U. S. Equal Employment Opportunity Commission discloses information about a case where two male employees were subject to racial and sexual harassment by their female manager and one employee was fired out of retaliation. In the EEOC lawsuit against Austin Foam Plastics, the company was charged with violating Title VII of the Civil Rights Act of 1964 by subjecting two African-American male employees to a sexually and racially hostile working environment and for the firing of one employee as a result of opposing and reporting the incidents. The male employees were harassed vehemently by their female manager through discriminatory intimidation, ridicule, insults, racially offensive comments and jokes, cartoons and images which denigrated African-Americans. The EEOC also charged that a female manager sexually harassed male employees by subjecting them to unwelcome sexual comments and unsolicited physical contact of a sexual nature and that she conditioned more favorable terms of employment on acquiescence to her sexual advances and overtures. The acts of sexual harassment, racial harassment, and retaliation all violate Title VII of the Civil Rights Act of 1964. The lawsuit was settled in 2010 and Austin Foam Plastics pays out $600,000 in damages. The preceding case signifies the reason why employers should implement preventive strategies to minimize risks of costly litigation. If the company adheres to strict policies regarding the development and auditing of its management team, some complaints may be avoided. In the article Sexual Harassment in the Workplace written by Karina L. Schrengohst, Esq. , the author indicates that the supervisor has a significant role in prevention. Schrengohst employs information from Massachusetts state statutes regarding sexual harassment in the workplace: â€Å"Massachusetts law and federal law prohibit sexual harassment in the workplace. Employers have an obligation to take reasonable steps to prevent sexual harassment before it arises and to create a harassment-free workplace. Toward this end, supervisors play an important role in identifying, preventing, and reporting sexual harassment. And in Massachusetts, supervisors have even more incentive to be vigilant because they can be held individually liable for inaction when they have knowledge of sexual harassment but fail to act† (2011). There are two types of sexual harassment: (1) quid-pro-quo harassment, and (2) hostile-work-environment harassment which are detailed by Schrengohst: â€Å"Quid-pro-quo harassment occurs when an employee’s submission to or rejection of sexual advances, requests, or conduct impacts a condition of his or her employment such as receiving or being denied a raise, a promotion or demotion, continued employment or termination, or a change of duties, hours, or compensation. Hostile-work-environment harassment occurs when unwelcome sexual advances, requests, or conduct are severe and pervasive enough to alter an employee’s working conditions or to interfere with work performance† (2011). The author discusses the necessity of â€Å"preventative steps† in the workplace to avoid such sexual harassment cases. Although most employers have written policies regarding sexual harassment in the workplace, enforcement and dissemination of these policies remains another area of discussion. Schrengohst also details the sexual harassment policies as listed by the Massachusetts Commission Against Discrimination: â€Å"A statement that sexual harassment in the workplace is unlawful;A definition and examples of sexual harassment; A reporting procedure, with several individuals identified as authorized to receive complaints;A statement of potential consequences for employees who are found to have committed sexual harassment;A statement that it is unlawful to retaliate against an employee who has complained about sexual harassment, filed a lawsuit, or participated in an investigation;Information about state and federal employment-discrimination enforcement agencies.This policy should be presented to all new employees at the start of employment and posted in the workplace. The policies for sexual harass ment are clearly written; however, a strict policy of training employees and management on the rigors of sexual harassment in the workplace must be employed. Discussion Employment law is a complex, ever-evolving specialty in the practice of law. Employees are well advised to seek competent professional legal advice when an employment law issue arises. Employment Law has many strict deadlines as it pertains to filing of claims, as such, it is imperative for employees to assert their rights as soon as possible. Oftentimes, it is advisable to seek legal representation before the adverse employment action occurs, such as, while the employee is still employed with the employer. Discrimination is one of the most prominent complaints handled by the EEOC. Each State, as a sovereign entity, is entitled to give additional protections for discrimination than those afforded by Federal Regulations. Sexual harassment is a form of sex discrimination, which includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. The federal and state level jurisdictions instituted anti-retaliation provisions which prevent an employer from retaliating against an employee for filing a sexual discrimination case. In quoting the definition of â€Å"Sexual Harassment† as listed on the EEOC website: â€Å"It is unlawful to harass a person (an applicant or employee) because of that person’s sex. Harassment can include â€Å"sexual harassment† or unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature. Harassment does not have to be of a sexual ature, however, and can include offensive remarks about a person’s sex. For example, it is illegal to harass a woman by making offensive comments about women in general. Both victim and the harasser can be either a woman or a man, and the victim and harasser can be the same sex. Although the law doesn’t prohibit simple teasing, offhand comments, or isolated incidents that are not ver y serious, harassment is illegal when it is so frequent or severe that it creates a hostile or offensive work environment or when it results in an adverse employment decision (such as the victim being fired or demoted). The harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of the employer, such as a client or customer. † Conclusion Because many unusual laws exist and there are many requirements exclusions, it is imperative that an employee who believes they have been wronged, or an employer seeking to comply with all employment laws, to seek the advice of competent counsel. In addition to the governmentally enacted laws, the employment relationship may be governed by written contracts (so long as the clauses do not violate inalienable rights). A sign of the increasing tensions in the area occurred in 1992 when the Serb army began shelling the National Library of Bosnia-Herzegovina in Sarajevo. Over a million books, more than a hundred thousand manuscripts and rare books, and centuries of historical records were destroyed and this can be considered to have been a systematic campaign of cultural eradication. A good case study of the Bosnian genocide would be the one that happened in Srebrenica. In July 1995, Serb troops and paramilitary units descended on the town of Srebrenica and began shelling it after dealing with the Muslim soldiers in the countryside, besieging the town’s thousands of Muslim civilians. The United Nations peacekeeping mission in the town which consisted of French and Dutch soldiers, could do little to help the civilian population and had to agree to a vague promise made by Mladic, the Serb commander, that everyone would be allowed to cross out of Serb territory but only after the screening of the men so that ‘war criminals’ could be detected. This promise proved to be false as witnessed when the men were separated from the women and children and the latter were forced into trucks and buses and deported. The men on the other hand were all killed and this process of large scale murder and deportation continued for the next four days. It is estimated that up to 7500 men and boys over thirteen years old were killed after being driven on trucks or marched to their places of death. It is said that up to 3000 were while in the act of escaping by being shot and decapitated in the field s. I put my bag in a safe and secure place so children cannot access. I check the message board and liaise with other staff members for any important updates. We have a child with a food intolerance so I informed the cook to make them aware the child was catered for at all meals during the day. My 1st hour was spent upstairs with the toddlers aged between 2 and 3 years. I then checked the planner to see what activities we had for that day. Today I set up the drawing table ensuring there was enough paper, crayons and chairs available for all the children present. I sat with the children whilst they joined in with the activity. Talking to the children about what they were doing and describing all the different colours, sizes, shapes etc. This was promoting their speech and language development and using creative skills too. Whilst supervising this activity I decided to complete a short observation on one of the children as she began to count and sing. I was interacting with all of the children trying to maintain interest. After a short while it was then time to tidy away all the equipment from the actives in which we encourage the children to help too. Once the room was tidy we decided to take the children outside in to the garden. Most of our toddlers are able to collect and put on their coats which we also encourage to do but some children are unable to achieve this at the moment. I helped to escort the children safely down the stairs ensuring they hold on to the rail and do a head count to make sure all children were present. I performed the outdoor risk assessment using the  daily check list. The children then are supervised using the toilet and washing their hands ready for lunch. I seat the children down at the tables ensuring they have cleaned their hands and they have adequate space to eat. I supply them all with a drink and we sing songs whilst the food is being dished out. I have prepared the child’s food separately who has the food intolerance ensuring they receive the correct meal . The child is also supervised eating to ensure they do not mix foods with the other children. Some children have not developed the skills to cut their own food so I will assist with helping them to do that. Ensuring the meals are cool enough I then give each child a meal and always remind them of good manners by saying â€Å"please† and â€Å"thank you†. If children do not like the meal or try to refuse it I will always encourage them to try it. If I am working alongside the babies the above applies except some of the babies are too young to feed themselves and have not yet developed those skills. Babies will also need help with bottle feeding. I would also prepare the bottle feeds following the nursery policy. Ensuring correct formula is mixed and all bottles have been sterilised. Back in the toddler room, a child was struggling with their food and looked like they was choking. I immediately helped the child by taking the food out of their mouth with my little finger. The child became distressed so I comforted them until they were able to return to their meal. Meal times are always supervised by all members of staff to help with any incidents like this. All meal times are recorded in the daily chart. This is where we write down what the child has eaten so we can relay this back to the parents/carers. When the children have finished their meal I help to clean the children up and get them ready for their afternoon sleep. I assist with the toileting and other members of staff will go through the nappy change routine. The children in the toddler room go to find their own sleep mats with the aid of their name and picture tag. Most children will remove their own footwear but again some have not yet developed those skills, so I will help. Some children have their own comforters which I put out for them and I help to get them off to sleep with gentle patting. Once the children are asleep, I ensure the room monitors are on and working, make sure the room temperature is ok and all the children have their own blankets and they are safe. I then record each child in the daily sleep chart. This chart is for ours and parents benefits. We record when they sleep and when they wake up. As some children are only allowed a certain amount of sleep, this will help us to know when we have to wake them up. I then check on the children in the sleep room every 10 minutes with the aid of a timer. When children wake from their afternoon sleep they are always asked to use the toilet. Some children are upset when they awake so I will always comfort them. The afternoon usually consists of taking the children outside for free play. I get all their coats bags etc together and help to put their coats on. On this occasion it was a nice sunny day so I applied their own sun cream following the nursery sun cream policy. I ensure they have sun hats and the sun cream is applied liberally. Before we go outside I take 4 children at a time down the stair and reiterate the importance of holding the hand rail. A head count is once again recorded and an outdoor check is done following the outdoor risk assessment. The toddlers are escorted outsi de counting each child as they go. They are shortly followed by the children/babies from the tiny room downstairs and they all play in the same garden. The children are supervised with in ratio. As its free play time, I leave the children to play but some children like me to join in with what they are playing with. Child A is playing with a dolls pram and child B is trying to take that away from them. I intervene and explain to child B â€Å"we do not take toys from our friends when they are playing with them, it’s not very kind†. Child B is upset so I took the child away and provided them with another toy to distract them from child A. This works very well and child B goes off playing happily alone with the other toy. Child A is also happy and also continues to play. Shortly after another incident happened where a child has fallen and bumped their head. As I comfort the child I asked another staff member to get a cold compress. This is applied to the child for 10 minutes whilst still trying to comfort the child. The head bump is not too bad and the child soon calms down and returns playing. I then completed an accident form following nursery policy. This is then signed by the parent when the child is collected. During the afternoon, parents/carers come to collect their children. I greet the parents and explain what their child has been doing throughout the day, taking the information off the daily record sheet. We usually have a short chat with the parents/carers about the child’s day and will also take interest in their day too. We have a good  relationship with our parents/carers and this also helps us to get to know the parents/carers and children too. After all the children have gone home, we tidy round and ensure the nursery is ready for the next day ahead. 2.1 Explain the importance of reflective practice in continuously improving the quality of service provided. The nursery setting is always changing is so many different ways. We have new children being welcomed in to the setting and then we have children going through different types of transitions. The service we provide must reflect the needs of the children and by constantly improving our services we can better meet the need of the children and support their development. By constantly reflecting on out practice we can assess where we may be lacking in skills or knowledge and we can update these regularly to keep our services up to date and as supportive to the children as possible. A good example on reflective practice is, we have a child that has developed an intolerance to milk, dairy products etc. We have briefed all staff members with information regarding lactose free diet for this child. We have a couple of children who have turned 2 years and have completed the transition u pstairs to the toddler room. This meant we have more babies downstairs in our tiny room and the room has been slightly equipped with more age relevant toys and equipment. If we did not reflect on this, it could hinder the development of the younger babies. Everyone makes mistakes – they are one way of learning. It is important not to waste your mistakes, so if something has gone wrong, make sure you learn from it. Discuss problems and mistakes with your supervisor, and work out how to do things differently next time. You can use reflective skills in order to learn from situations that have not worked out the way you planned. It is important that you consider carefully why things turned out the way they did and think about how you will ensure that they go according to plan next time. Talking to colleagues and supervisors is equally useful when things work out really well, as it is important to reflect on success as well as failure. Assembler Directives of 8086 Microprocessor INTRODUCTION: Assembly languages are low-level languages for programming computers, microprocessors, microcontrollers, and other IC. They implement a symbolic representation of the numeric machine Codes and other constants needed to program a particular CPU architecture. This representation is usually defined by the hardware manufacturer, and is based on abbreviations that help the programmer to remember individual instructions, registers. An assembler directive is a statement to give direction to the assembler to perform task of the assembly process. It control the organization if the program and provide necessary information to the assembler to understand the assembly language programs to generate necessary machine codes. They indicate how an operand or a section of the program is to be processed by the assembler. An assembler supports directives to define data, to organise segments to control procedure, to define macros. It consists of two types of statements: instructions and directives. The instructions are translated to the machine code by the assembler whereas directives are not translated to the machine codes. Example: GLOBAL DIVISOR: WORD tells the assembler that DIVISOR is a variable of type of word which is in another assembly module or EXTERN. (8) SEGMENT: It is used to indicate the start of a logical segment. It is the name given to the the segment. Example: the code segment is used to indicate to the assembler the start of logical segment. (9) PROC: (PROCEDURE) It is used to identify the start of a procedure. It follows a name we give the procedure. After the procedure the term NEAR and FAR is used to specify the procedure Example: SMART-DIVIDE PROC FAR identifies the start of procedure named SMART-DIVIDE and tells the assembler that the procedure is far. (10) NAME: It is used to give a specific name to each assembly module when program consists of several modules. Example: PC-BOARD used to name an assembly module which contains the instructions for controlling a printed circuit board. (11) INCLUDE: It is used to tell the assembler to insert a block of source code from the named file into the current source module. This shortens the source module. An alternative is use of editor block command to cop the file into the current source module. (12) OFFSET: It is an operator which tells the assembler to determine the offset or displacement of a named data item from the start of the segment which contains it. It is used to load the offset of a variable into a register so that variable can be accessed with one of the addressed modes. Example: when the assembler read MOV BX.OFFSET PRICES, it will determine the offset of the prices. (13) GROUP: It can be used to tell the assembler to group the logical segments named after the directive into one logical group. We witness these journeys not only through observations of a character going through a personal transformation but a whole culture around him who is likewise in turmoil. This film allows us to join in on an adventure and journey of the character, the world he enters and the people he meets. The story is based on a time just after the Civil War, a time when the modern western world which had just encroached upon the American West, condemning the Native American, began to engulf traditional Japan as well. The purpose of this film is to give a voice to these people, to share in their struggles and experiences and be enlightened, as the protagonist is, at their way of living and their out look on life and its purpose. The audience is simply people with a connection to the struggles of a culture undergoing rapid changes by modern development. Any person passionate about culture and tradition and simply, any person who can open their mind to a world unknown to them and to learn from it. As well as this we must recognize that it is a Hollywood production and its purpose first and foremost would be entertainment, and being able to satisfy the wants of the majority. My all time favorite place to be is the beach. The weather at the beach is the most quarreling of all places in the world. One minute you are relaxing lazily on the sandy seashore reading a most invigorating book. I sit engrossed and allow the foamy mist from the rampant ocean spray your face lightly as though it was the touch of a feather. A violent explosion of heavenly emotion has replaced my peaceful evening. Teacher of Year

First I want to tell you with whom I honor, with whom I have, learned to respect, and who deserve the outmost admirations. The teachers I am talking about work hard to do a great job, because, above all, it is a kind of responsibility so to speak towards their students and relevantly toward themselves. I have had several teachers in my years as a student both in the primary and secondary schools among which there were only few whom I felt to fit the description above, maybe most of them were good in their own way, but one cannot be sufficient in all ways or I may also have misunderstood them. However, the teacher that I chose as deserving of the â€Å"My Favorite Teacher† earned this title due to the care she showed to each of her students through her teaching, personality, and the all the fun had in her class is Ms. Fleming my writing teacher. Ms. Fleming is an open minded, caring person who seemed to love what she is doing. Ms. Fleming is more than a teacher to me; she is a person you could go to with a problem and she would try and help you find the answer. She would help you, but expected you to put the work into finding out for yourself how to do something. She always came across as someone who cared about every student as if they were her â€Å"children†. Ms. Fleming is like a book that gives you the right information that would help you on getting a six on the FCAT writing. About 95% of her student’s agree that Ms. Fleming spent each day preparing us for the FCAT writing in thirteen days. The first time I walked into the classroom I notice a flaming red headed teacher sitting down. I thought that she would be a boring, and mean teacher giving her student’s a lot of homework and essays to write. Every word that comes out of her mouth sounds like music to my brain. When it comes to teaching she doesn’t let out a lot of stress, most of the stress comes from whether or not her student’s would receive a four or higher on the FCAT writing. When I’m in class Ms. Fleming have a way of teaching her student’s on how to write a splendiferous essay. Ms. Fleming is always making her student’s laugh on how she comes up with ridiculous ideas to explain the assignment. Take your left stars and right stars and switch them in order to create a perfect planning sheet,† said Ms. Fleming. Once we complete this task for our essay’s we can start drafting and then finish a final copy with an added taste! Ms. Fleming is no ordinary teacher like other teachers from North Miami Beach Senior High School. This is much I appreciate and amorous, benevolent person that would help me with my writing and achieving my goals to pass the FCAT writing test this ye ar.
